The introduction of the NVES will result in an unheralded transformation of the automotive retail and aftermarket repair sector.

By the end of June 2024, Telstra will deactivate its extensive 3G network, with Optus expected to follow suit later in the year.
TPG/ Vodafone has already completed the shutdown of their 3G services.

VACC members are advised the national body representing VACC members, the Motor Trades Association of Australia (MTAA) entered a submission, on behalf of members, in response to the Australian Government’s COVID-19 Response Inquiry (the Inquiry). Prime Minister, Anthony Albanese announced the Inquiry in September 2023 with the intention to develop recommendations aimed at improving Australia’s preparedness for future pandemics.

The Federal Government has released its Migration Strategy in response to the Parkinson Review.
A key point made in the strategy relates to reducing the overall net migration, stating their intention to reduce the overall Net Overseas Migration (NOM) by 180,000 over the next five years.

You would be aware of the inherent cyber security threats all businesses face daily. The risk of an attack has the potential to completely ruin your business, which is why it is important to ensure you have the necessary safeguards in place. Small businesses are particularly vulnerable to cyber risks due to limited resources, infrastructure and a lack of awareness. Unfortunately, the VACC has received calls from members who have been compromised from clicking on suspicious emails, using easy to decipher passwords, and from using software without the critical updates being installed.

From today, 9 November 2023, Australia’s unfair contract terms regime is changing. The changes include expanding the unfair contract terms regime to ‘small businesses’ that have fewer than 100 employees OR turnover of less than $10m. New civil penalty provisions for non-compliance will also apply.

Hybrid and Electric Vehicle training in Victoria in 2022

VACC is actively seeking to run Hybrid and Electric Vehicle training in Victoria in 2022. This training is based on units of competencies outlined within AURSS00034 – battery electric vehicle diagnosis and repair and AURSS00035 – battery electric vehicle inspection and servicing skill sets and AURETH101 - Depower and reinitialise battery electric vehicles. Currently, there is no accredited EV training available in Victoria; however, in our discussions with government we are aiming to deliver the required training next year if we have enough people interested.

The Victorian Government has announced a new round of grants for eligible small to medium-sized businesses that includes assisting employers and sole traders impacted by the recent circuit breaker restrictions.  The program offers grants between $2,500 – $5,000 to businesses with an annual payroll of up to $10 million. Applications are open until 11:59pm Thursday 24 June 2021.

These changes heightened concerns VACC raised in respect to the scope of work members could undertake in the service, repair and sale of vehicles. Urgent clarification on these changes was sought and a meeting with government was held this afternoon.

Earlier this week, Premier Daniel Andrews made a number of announcements regarding the easing of coronavirus restrictions in Victoria.  Based on advice from the Chief Health Officer, businesses can begin planning for a phased re-opening as of 1 June.

This includes:
1 June – Cafes, restaurants and pubs will be able to reopen their doors to serve meals up to 20 customers at a time per enclosed space.
From 22 June – this could increase to 50 patrons.
During second half of July, up to 100.

The caveat is it all depends on how Victoria is tracking once each deadline approaches.

This may be welcome news to some members, particularly those in the Service Station division who have a café component to their business.

This week saw the relaxing of some state wide restrictions – which includes the reopening of auction houses.  Members and the public will now be able to run and attend, in-person vehicle auctions with up to 10 people plus those facilitating the process.

I would also like to draw your attention to the work being done by our Industrial Relations and Policy teams regarding temporary amendments to the Vehicle Manufacturing, Repair Services and Retail Award.  Its focus is to assist businesses who do not quality of the JobKeeper package.  You can read more about it in the segment below.

The recent Victorian Government announcement of an additional $491million in tax relief will be welcome news to many members.  The extended tax relief includes a range of measures: freezing various fees, charges and levies, and will likely have a positive impact on those accessing the JobKeeper package.  This is in addition to the recently expanded Small Business Support Fund (announced last Friday, 1 May).  Both support packages are covered in more detail in subsequent sections of this Update.

Please be aware the Victorian Government announced on 1 May, that it will be expanding the small business support fund to include businesses with a payroll tax threshold of less than $650,000, has an annual turnover of more than $75,000 and who are participating in the Commonwealth JobKeeper program.  Your businesses name is also required to be registered with Australian Securities and Investments Commission (ASIC).  This means that any automotive business that fits this criterion is now eligible for the $10,000 government grant.

Today the Prime Minister and Premiers have agreed to a mandatory code of conduct for commercial tenancies to be legislated across all states and territories.  The new rules will apply to commercial tenancies where the tenant or landlord is eligible for the JobKeeper payment and has a turnover of $50 million or less.  Overall this is considered a good thing for a small business and no doubt greatly appreciated by those who qualify.

Today VACC publicly distributed its firm position on the classification of ‘essential services’ to politicians and the media.
VACC has adopted the position of its national body, The Motor Trades Association of Australia (MTAA) in regard to the classification of ‘essential services’. VACC and MTAA’s position is automotive retail, repair, service and parts roles are critical in supporting the transportation of essential goods and services during any potential shut-down, dictated by government. The absence of this valuable supply and service chain will likely leave the national and state vehicle fleets unable to provide essential services, and this extends to the provision of food and medical supplies desperately needed by the broader community.

Today the Australian Banking Association announced Australian banks will defer loan repayments for small businesses affected by COVID-19 for six months.
The assistance will apply to more than $100bn of existing small business loans.  VACC applauds the move after repeatedly lobbying for loan assistance for small businesses.

A new legal framework under the Environment Protection Amendment Act 2018, the general environmental duty (GED) will come into effect on 1 July 2020. This will require Victorians to understand and minimise their risks of harm to human health and the environment, from pollution and waste.  The Act will change the way EPA currently work with the public and businesses in Victoria, switching from responding to pollution events to focus on preventative measures.

On October 30, the Victorian Government introduced a new Bill into the Parliament - the Retail Leases Amendment Bill 2019.

We wish to advise of a change in TNT’s shipping policy which will come into effect on 5 August 2019.  All engines, engine componentry and transmissions from non-Original Equipment Manufactures (OEM’s) will no longer be accepted.  TNT have outlined the reasons behind this change which in most part is about ensuring the safety of their staff and reducing the risk of damage to other consignments and/or equipment.  Changes in legislation e.g. the heavy vehicle national law Chain of Responsibility responsibilities has also prompted this change.

US President Trump issued a Proclamation on 17 May in response to the Section 232 investigation into automotives and auto parts. The Proclamation directed the United States Trade Representative Robert Lighthizer to enter into negotiations with the EU and Japan to limit imports of automobiles and some automotive parts (engines and engine parts, transmissions and powertrain parts, and electrical components). The investigations could last up to six months, and at this stage no tariffs or quotas have been announced. USTR Lighthizer will report to the President on the progress and outcomes of the negotiations within 180 days (13 November 2019).

This occurs where a customer has not returned a rental vehicle by a designated date and all attempts to contact the customer have failed.

VACC is seeking to support its Car Rental Industry members who are dealing with varying degrees (if any) of assistance from Victoria Police. Victoria Police often treat this issue as a civil matter. This can be frustrating. We must find a fair and practical solution.

Technician Hit By Vehicle In the Workshop

An apprentice technician was conducting a service on a vehicle that was located on the ground, parked in a hoist bay. When the apprentice started the vehicle, he unknowingly bumped the gear lever into drive.  The technician then revved the vehicle and the vehicle moved forward quickly.  At the time of the vehicle moving forward unintentionally, another apprentice technician was reviewing a repair order at the workbench in front of the uncontrolled vehicle.  The apprentice was struck by the vehicle and pinned against the workbench.

Members were advised in Bulletin D01-16 of an announcement made by the Federal Minister for Major Projects, Territories and Local Government, The Hon Paul Fletcher MP, regarding reforms of the Motor Vehicle Standards Act (the ACT). The reforms will amongst other things reduce current restrictions on the parallel importation of new cars and motorcycles.
