Many of you would be aware of the Federal Government’s proposed New Vehicle Fuel Efficiency Standard (NVES), which aims to reduce vehicle emissions over time and is due to come into effect from 1 January 2025. The introduction of the NVES will result in an unheralded transformation of the automotive retail and aftermarket repair sector.

By the end of June 2024, Telstra will deactivate its extensive 3G network, with Optus expected to follow suit later in the year.
TPG/ Vodafone has already completed the shutdown of their 3G services.

 

The Motor Trades Association of Australia (MTAA) recently released its report into automotive skills shortages across Australia. The report, conducted by Deloitte Access Economics, is entitled:

VACC members are advised the national body representing VACC members, the Motor Trades Association of Australia (MTAA) entered a submission, on behalf of members, in response to the Australian Government’s COVID-19 Response Inquiry (the Inquiry). Prime Minister, Anthony Albanese announced the Inquiry in September 2023 with the intention to develop recommendations aimed at improving Australia’s preparedness for future pandemics.

As we approach the Christmas – New Year holiday period, VACC appreciates that it can be a stressful and challenging time of year for some.

The Federal Government has released its Migration Strategy in response to the Parkinson Review.
A key point made in the strategy relates to reducing the overall net migration, stating their intention to reduce the overall Net Overseas Migration (NOM) by 180,000 over the next five years.

You would be aware of the inherent cyber security threats all businesses face daily. The risk of an attack has the potential to completely ruin your business, which is why it is important to ensure you have the necessary safeguards in place. Small businesses are particularly vulnerable to cyber risks due to limited resources, infrastructure and a lack of awareness. Unfortunately, the VACC has received calls from members who have been compromised from clicking on suspicious emails, using easy to decipher passwords, and from using software without the critical updates being installed.

 

With cost of living pressures impacting so many of us, particularly those new to the workforce, it is a timely reminder that the Victorian Government’s free vehicle registration is currently open to eligible trade apprentices. This includes automotive trades related apprentices.

From today, 9 November 2023, Australia’s unfair contract terms regime is changing. The changes include expanding the unfair contract terms regime to ‘small businesses’ that have fewer than 100 employees OR turnover of less than $10m. New civil penalty provisions for non-compliance will also apply.

Today, the Motor Trades Association of Australia (MTAA), along with a number of other major automotive industry associations, met with government regarding the ending of the Temporary Full Expensing Scheme (Instant Asset Write Off) on 30 June 2023.

This standard specifies requirements for restraining devices for child occupants of passenger cars and their derivatives, such devices being intended, when properly selected, correctly installed and correctly adjusted, to reduce the risk of bodily injury in a vehicle impact. The devices may also have application to other types of vehicles.

 

As announced in the recent 2023/24 Victorian Budget, the state government will make vehicle registration free for eligible apprentices from 1 July this year.

Contract law can be complicated, but the principle is simple: big and powerful businesses must stop putting unfair contract terms (UCT) into their contracts with consumers and small businesses. The Victorian Automotive Chamber of Commerce (VACC) welcomes the Federal Government introducing legislation (a Bill) to enhance the protections against unfair contract terms. The Bill has passed both Houses of Parliament.

Last night the Treasurer Jim Chalmers delivered the first Budget of the new Labor Government. This is essentially an update of the 2022-23 Budget handed down by the previous government in March this year. This Budget brings the Labor’s policy priorities and plans into the official financial accounts.

As you will be aware the Federal Government has now concluded its two day, widely publicised, Job and Skills Summit.

The Victorian Government has opened a grants program providing $2,000 to eligible Victorian small businesses to help pay for specialist business advice from an accountant, bookkeeper or lawyer.

VACC is actively seeking to run Hybrid and Electric Vehicle training in Victoria in 2022. This training is based on units of competencies outlined within AURSS00034 – battery electric vehicle diagnosis and repair and AURSS00035 – battery electric vehicle inspection and servicing skill sets and AURETH101 - Depower and reinitialise battery electric vehicles. Currently, there is no accredited EV training available in Victoria; however, in our discussions with government we are aiming to deliver the required training next year if we have enough people interested.

The Australian Competition and Consumer Commission (ACCC) has released a survey seeking feedback from consumers, businesses and other stakeholders as part of its annual review of the ACCC’s Compliance and Enforcement Policy and Priorities.

In response to unprecedent demand, VACC is hosting a second webinar for members on COVID-19 Vaccinations in the workplace on Friday, 15 October 2021.

VACC has received a high volume of calls relating to Mandatory Vaccinations (Workers) Directions under Public Health and Wellbeing Act 2008 (Vic).

The Fund provides grants to eligible small landlords who experience hardship as a result of waiving rent for their tenant(s) between 28 July 2021 and 15 January 2022 under the Commercial Tenancy Relief Scheme.

VACC members are advised that the Victorian Government’s Commercial Tenancy Relief Scheme (the Scheme) for Victorian small business owners to obtain rent relief backdated to 28 July 2021 will require you to make an application by 30 September 2021.

VACC welcomes today’s announcement released by the Federal and Victorian Governments regarding extra support for small and medium sized businesses impacted by the recent lockdown.

VACC members are advise that from 1 July, that vehicle recalls will no longer be published by the Australian Competition and Consumers Commission (ACCC).

Please be advised that VACC has finalised and submitted a response to the Draft Road Safety (Vehicles) Regulations 2021 and the Regulatory Impact Statement (RIS) released by the Department of Transport.

Members are advised of changes that will take effect to the Federal Chamber of Automotive Industries (FCAI) website www.ismyairbagsafe.com.au from July 1, 2021.  FCAI is the peak body that represents the vehicle manufacturers in Australia.

An important change to the Australian Consumer Law (ACL) will take effect from 1 July 2021.  The changes will result in a broadening of the definition of a “consumer” under the ACL.

The moment we’ve been waiting for is finally here. Today the Morrison Government, and in particular, the Assistant Treasurer, The Hon Michael Sukkar MP passed a law to make car manufacturers service and repair information available to independent repairers at a fair market price.

The Department of Transport has released the draft Road Safety (Vehicles) Regulations 2021 and is inviting submissions on proposed regulatory reforms.  The Road Safety (Vehicles) Regulations 2021 deal with a range of issues relating to the registration of vehicles and trailers, vehicle safety and standards.

VACC has received advice from The Department of Agriculture, Water and the Environment that the Australian Refrigeration Council (ARC) will now accept qualifications prior to 2005. i.e: trade papers.

The Victorian Government has announced a new round of grants for eligible small to medium-sized businesses that includes assisting employers and sole traders impacted by the recent circuit breaker restrictions.  The program offers grants between $2,500 – $5,000 to businesses with an annual payroll of up to $10 million. Applications are open until 11:59pm Thursday 24 June 2021.

The Victorian Automotive Chamber of Commerce (VACC) advises all members that the Australian Competition and Consumer Commission (ACCC) has made a class exemption, which allows eligible businesses to collectively bargain without breaching the competition laws.  The class exemption is available for businesses to use from 3 June 2021.
 

The State Revenue Office (SRO) has announced extended land tax relief until 30 June 2021. This applies to all categories: residential landlords, commercial landlords and commercial owner-occupiers.

Today marks a historic day for the Australian automotive service and repair industry.  The Hon Michael Sukkar MP this morning presented a Bill for an Act to amend the Competition and Consumer Act 2010 in relation to sharing information for motor vehicle service and repair, and for related purposes "Competition and Consumer Amendment (Motor Vehicle Service and Repair Information Sharing Scheme) Bill 2021".

The Australian Government has recently announced an initiative called ‘NewAccess for Small Business Owners’. This provides free, confidential and tailored mental health coaching to small business owners. The program is part of the Government’s $7 million BusinessBalance initiative, providing immediate, short-term support of mental and financial wellbeing for small business as it recovers from the COVID-19 pandemic.

VACC has sought and received specific guidance from the Victorian Government with respect to unclear terms contained within the Stage 4 Restrictions that have been imposed on the automotive retail sector.

 

VACC members are advised that the Federal government yesterday released the Government Response to the Parliamentary Joint Committee on Corporations and Financial Services’ Fairness in Franchising report.

At 11.59pm 5 August 2020 the Victorian Government made changes to its Stage 4 COVID Restrictions advice.

These changes heightened concerns VACC raised in respect to the scope of work members could undertake in the service, repair and sale of vehicles. Urgent clarification on these changes was sought and a meeting with government was held this afternoon.

 

On Monday this week the Victorian Government provided the new conditions for Stage 4 coronavirus restrictions. The new conditions primarily affect metropolitan VACC members whose post code is encapsulated in the Stage 4 boundaries.

Yesterday Premier Daniel Andrews announced further stage 4 restrictions for Metropolitan Melbourne that are aimed at industries where onsite operations will have to close for the next six weeks as of 11:59pm Wednesday, 5 August.

The information below will be of benefit to some LMCTs and car rental operators.  The Victorian Government has agreed, in order to assist businesses with recovery from COVID19, to a simplified re-registration process for business-use vehicles (including vehicles registered to LMCTs).

VACC supports the practice of responsible community behaviours and remain firmly aligned with the edicts put forward in the Victorian Deputy Chief Health Officers directions released on 30 June that announce new restrictions on community and business in defined northern and western suburbs of Melbourne.  The restrictions are aimed at preventing the spread of COVID-19 emanating from postcodes defined as COVID-19 restricted postcodes.

Earlier this week, Premier Daniel Andrews made a number of announcements regarding the easing of coronavirus restrictions in Victoria.  Based on advice from the Chief Health Officer, businesses can begin planning for a phased re-opening as of 1 June.

This includes:
1 June – Cafes, restaurants and pubs will be able to reopen their doors to serve meals up to 20 customers at a time per enclosed space.
From 22 June – this could increase to 50 patrons.
During second half of July, up to 100.

The caveat is it all depends on how Victoria is tracking once each deadline approaches.

This may be welcome news to some members, particularly those in the Service Station division who have a café component to their business.

This week saw the relaxing of some state wide restrictions – which includes the reopening of auction houses.  Members and the public will now be able to run and attend, in-person vehicle auctions with up to 10 people plus those facilitating the process.

I would also like to draw your attention to the work being done by our Industrial Relations and Policy teams regarding temporary amendments to the Vehicle Manufacturing, Repair Services and Retail Award.  Its focus is to assist businesses who do not quality of the JobKeeper package.  You can read more about it in the segment below.

Members may be relieved that Premier Daniel Andrews has finally announced details of the easing of some coronavirus restriction; however, we are all aware it is far from business as usual.  The VACC website provides a comprehensive summary of the announcement, along with useful links. This week has seen the lifting of restrictions by some states and territories – Victoria, however, has stood firm in their approach to maintaining the status quo until Cabinet meets to discuss a review on Monday, 11 May.  We will await further announcements with interest, but in the meantime, VACC has been busy advocating that Auto is Open.

The recent Victorian Government announcement of an additional $491million in tax relief will be welcome news to many members.  The extended tax relief includes a range of measures: freezing various fees, charges and levies, and will likely have a positive impact on those accessing the JobKeeper package.  This is in addition to the recently expanded Small Business Support Fund (announced last Friday, 1 May).  Both support packages are covered in more detail in subsequent sections of this Update.

The Victorian Government has today announced additional payroll tax relief to support businesses during the COVID-19 pandemic.

Please be aware the Victorian Government announced on 1 May, that it will be expanding the small business support fund to include businesses with a payroll tax threshold of less than $650,000, has an annual turnover of more than $75,000 and who are participating in the Commonwealth JobKeeper program.  Your businesses name is also required to be registered with Australian Securities and Investments Commission (ASIC).  This means that any automotive business that fits this criterion is now eligible for the $10,000 government grant.

As we approach the end of week six living with coronavirus restrictions, we remain hopeful we will begin to see an easing of restrictions soon.

Just when you thought you knew all there was to know about JobKeeper, the Government has made further announcements regarding the relief package.

In Tuesday’s Update we provided additional resources to help members navigate the next phase of the JobKeeper payment –  now open to enrolments.  We understand there is a lot of information to take in, and so encourage you to reach out to our team to assist you at any stage.

As week four of the coronavirus restrictions comes to close, it seems returning to our previous way of life is still some way off, with the Prime Minister announcing a four-week deadline for reviewing the next steps on restrictions.

Earlier today I issued a bulletin to members regarding the recently announced commercial tenancy relief scheme designed to alleviate financial hardship faced by tenants and landlords as result of COVID-19.

Members should be aware of an announcement on 15 April  from the Victorian Government of a commercial tenancy relief scheme to alleviate financial hardship faced by tenants and landlords as a result of coronavirus (COVID-19).

We understand there seems to be an overload of information on all things COVID-19, and our aim is to keep these Updates as brief as possible – outlining the most important points allowing members to stay informed.

Earlier today I released a bulletin relaying advice received from the Office of the Minister for Police, the Hon Lisa Neville MP.  VACC had written to the Minister seeking clarity of messaging for staff and consumers travelling to automotive businesses.

The Victorian Automobile Chamber of Commerce (VACC) acknowledges Victoria Police are in a difficult position when dealing with recalcitrant community behaviour regarding COVID 19 and support the work of Victoria Police in the enforcement of the Chief Health Officers (CHO) directions to prevent the spread of COVID-19.

Last night, Parliament passed the Federal Government’s Jobkeeper legislation, which has made significant and helpful amendments to the Fair Work Act, enabling businesses to introduce operational changes to counter the downturn caused by the coronavirus crisis.

Today we have been waiting on more specific detail from the Federal Government regarding their much publicised JobKeeper package.

Today the Prime Minister and Premiers have agreed to a mandatory code of conduct for commercial tenancies to be legislated across all states and territories.  The new rules will apply to commercial tenancies where the tenant or landlord is eligible for the JobKeeper payment and has a turnover of $50 million or less.  Overall this is considered a good thing for a small business and no doubt greatly appreciated by those who qualify.

The voice of VACC and other associations has been heard loud and clear by government with the announcement of a new Australian Government grants program designed to retain employees in the workforce, and to keep businesses viable.  VACC has relayed to government major employment and labour challenges should businesses stand-down or make mass redundancies as a result of rapid downturns in business activity.

The Prime Minister has just announced an additional $130 billion ‘Job Keeper’ package.  This is no doubt welcome news to many VACC members – both large and small.  The package will see a payment of $1,500 flat payment per fortnight.

As the impact of the coronavirus on business and society continues, it’s important to take your mental health and the mental health of your staff seriously.  

The current COVID-19 pandemic is understandably creating uncertainty and anxiety for many members.  Managing our mental health and being aware of how we are coping is important to all of us – because we all react differently to pressure points. Being able to come out the other side is critical, as is building resilience.

The Federal Government has now announced its Stage 2 response – with a Stage 3 response imminent. A full list of Stage 1 and 2 restrictions can be accessed HERE.

Today VACC publicly distributed its firm position on the classification of ‘essential services’ to politicians and the media.
VACC has adopted the position of its national body, The Motor Trades Association of Australia (MTAA) in regard to the classification of ‘essential services’. VACC and MTAA’s position is automotive retail, repair, service and parts roles are critical in supporting the transportation of essential goods and services during any potential shut-down, dictated by government. The absence of this valuable supply and service chain will likely leave the national and state vehicle fleets unable to provide essential services, and this extends to the provision of food and medical supplies desperately needed by the broader community.

Today the Australian Banking Association announced Australian banks will defer loan repayments for small businesses affected by COVID-19 for six months.
The assistance will apply to more than $100bn of existing small business loans.  VACC applauds the move after repeatedly lobbying for loan assistance for small businesses.

Given the situation at hand, which is the COVID-19 crisis, special and most critical consideration is required to be given to vehicle’s cleanliness, inbound and outward bound.

As the COVID-19 virus continues to wreak havoc on our health, families, communities, businesses and economy, it will begin affecting the automotive industry also, if it hasn't already. In saying this it only makes sense that we should consider the ways it could affect the automotive industry and begin taking steps to offset them now.  Below is a list I hope you find helpful in preparing for what we all hope is a short-lived situation that does not affect our businesses and our people.

A new legal framework under the Environment Protection Amendment Act 2018, the general environmental duty (GED) will come into effect on 1 July 2020. This will require Victorians to understand and minimise their risks of harm to human health and the environment, from pollution and waste.  The Act will change the way EPA currently work with the public and businesses in Victoria, switching from responding to pollution events to focus on preventative measures.

Members are advised that VACC has forwarded its 2021-2021 Victorian Pre- Budget submission to the Victorian Government.

VACC would like to draw members’ attention to a new portal established specifically for businesses in bushfire-affected areas.

On October 30, the Victorian Government introduced a new Bill into the Parliament - the Retail Leases Amendment Bill 2019. 

The Bill makes a few changes to the Retail Leases Act and is designed to make it easier for small business owners to understand their leases, get their money back quicker, remove confusion around legal obligations and lease terms and conditions, and enhance building safety.
 

If you or your company are involved in the importation of motor vehicles into Australia, then please take notice of recent enforcement action taken by the Department of the Environment and Energy. 

Recently VACC has received reports from some members outlining the devastating impact that rising land tax is having on their businesses. 

Under the Andrews Government, land taxes have more than doubled over the last five years - up by 109 per cent.  In many cases, land tax bills have soared between 50 and 100 per cent in one year.

We wish to advise of a change in TNT’s shipping policy which will come into effect on 5 August 2019.  All engines, engine componentry and transmissions from non-Original Equipment Manufactures (OEM’s) will no longer be accepted.  TNT have outlined the reasons behind this change which in most part is about ensuring the safety of their staff and reducing the risk of damage to other consignments and/or equipment.  Changes in legislation e.g. the heavy vehicle national law Chain of Responsibility responsibilities has also prompted this change. 

On behalf of Ken Eagle, Chair of the VACC Towing Operators Division, and his executive committee, VACC is very pleased to announce a substantial increase in storage rates for Towing operators. VicRoads has published the new rates effective from yesterday.

US President Trump issued a Proclamation on 17 May in response to the Section 232 investigation into automotives and auto parts. The Proclamation directed the United States Trade Representative Robert Lighthizer to enter into negotiations with the EU and Japan to limit imports of automobiles and some automotive parts (engines and engine parts, transmissions and powertrain parts, and electrical components). The investigations could last up to six months, and at this stage no tariffs or quotas have been announced. USTR Lighthizer will report to the President on the progress and outcomes of the negotiations within 180 days (13 November 2019).

Members are advised that on 22 March 2019 the Andrews Labor Government announced that it would begin trialling new technology to crack down on number plate theft and cloning.  The trials are a partnership between VicRoads, Department of Justice and Community Safety, Victoria Police and La Trobe University.

Scammers regularly target small businesses and are often successful in their illegal dealings to defraud innocent parties. Members should remain diligent and sceptical and should inform staff immediately of any known new scam.

Members would be aware that supplying a vehicle with an Affected Takata Airbag Inflator (ATAI) is prohibited in certain circumstances under the Takata compulsory recall.

VACC members are advised that further consultation with the administrators of the PPSR, the Australian Financial Security Authority (AFSA) has resulted in compulsory Takata airbag recall information can be included on PPSR Search Certificates.

The Victorian Automobile Chamber of Commerce (VACC) Divisional Elections 2018 are now open.
We encourage all qualifying members to consider joining one of our 15 industry divisions.

The following information is aimed at providing you with an update on the issue of access to restricted manufacturer repair and service information.

VACC have long advocated for a solution to this issue culminating into the signing of the Voluntary code back in December 2014 of which, the VACC under the umbrella of the Motor Trades Association of Australia (MTAA), are signatory to.

VACC, with the support of the Australian Trade Commission (Austrade), is planning to deliver a five day, automotive focussed trade mission to India to capitalise on the FISITA World Automotive Congress being held in Chennai, India from 2-5 October.

This mission is open to all VACC members with an interest in exploring new, international markets.  We are currently canvassing Expressions of Interest at this stage to gauge industry interest.

The Small Business Festival runs from August 1 - 31.

This year the Victorian Small Business Commission (VSBC) will host a number of events at the festival, including a panel in partnership with beyondblue on "Looking after your mental health" and "Meet the Regulators" to allow you to tap into advice from government agencies about how to manage and grow your business.

This information session will discuss what the hydrofluorocarbon (HFC) phase down means for HFC users, including equipment owners and technicians, and other changes to the Ozone Protection and Synthetic Greenhouse Gas Program to reduce emissions and increase efficiency. There will be plenty of opportunity for questions and discussion.

VACC members would be aware that on 22 March 2018 the Senate passed a motion made by Senator John Williams to refer a matter to the Parliamentary Joint Committee on Corporations and Financial Services (Joint Committee) for inquiry and report by 30 September 2018 (Senate Inquiry) into the Franchising and Oil Codes of Conduct (the Code).

What is VACC’s policy position on the Franchise Code?

Members are advised of a series of webinars to be hosted by the Victorian Small Business Commission (VSBC).

Topics to be covered in the webinars include retail leases, franchising, reading the fine print in contracts and the benefits of dispute resolution.

Members of the Victorian Vehicle Rental Industry Group (VVRIG) have approached VACC seeking clarity on how Victoria Police record instances of non-returned or stolen rental cars. This occurs where a customer has not returned a rental vehicle by a designated date and all attempts to contact the customer have failed.

VACC is seeking to support its Car Rental Industry members who are dealing with varying degrees (if any) of assistance from Victoria Police. Victoria Police often treat this issue as a civil matter. This can be frustrating. We must find a fair and practical solution.

In a major win for car dealers, efficiency and cost- effective changes have been made to the Personal Property Securities Register (PPSR) effective from 18 June 2018.
VACC has engaged in extensive consultation between member LMCTs and the Australian Financial Security Authority (AFSA). The changes have been designed in response to VACC Used Car Trader Division & Victorian Automobile Dealer Association Executive Committee feedback.
The changes are available exclusively to automotive industry participants who are registered to use the PPSR.

A recent decision made by the Victorian Court of Appeals in the IMCC Group (Australia) Pty Ltd v CB Cold Storage Pty Ltd broadens the coverage of the Retail Leases Act 2003 (the Act).  Members should be aware that the Act may now apply to premises used for supplying commercial services to other businesses.  This means that a premises that is used to produce a good for sale could be covered by the Act.

Franchise dealer members should be aware that VACC Deputy Executive Director, Mrs Leyla Yilmaz and VACC Industry Policy Advisor, Mr Stuart Strickland OAM, were invited to a meeting in Canberra with Senator for New South Wales, Mr John Williams, to discuss current issues of concern automotive franchisees.

The Australian Government has acted on its commitment to reduce the use of hydrofluorocarbons (HFC’s) by 85 per cent by 2036 in accordance with the Montreal Protocol requirements. Australia’s phase down of HFC’s began on 1 January 2018 and is implemented through the Ozone Protection and Synthetic Greenhouse Gas Program.

The Takata Airbag Recall Notice issued on 27 February 2018 has caused massive concern to industry, particularly to those involved in the buying, selling and repair of affected vehicles.

Please be advised that today the Assistant Minister to the Treasurer, The Hon. Michael Sukkar MP, issued a compulsory recall for all vehicles fitted with defective Takata airbags. The ACCC advises that there are approximately 2.3 million vehicles in Australia presently equipped with the Affected Takata Airbag Inflators.

Victoria Police has informed VACC of an increase in burglaries and theft of motor vehicles across the whole of Monash police service area. In particular from car dealerships as well as more recently auto mechanic workshops. The offenders are breaking in and ransacking premises until they find the keys of the vehicles and are then stealing the vehicles along with the hard drives from CCTV cameras.

Members have been advised that VicRoads’ Dealer Online services will be switched off this Friday 16 December, 2016. VicRoads and VACC have made multiple attempts to contact dealers to migrate them from Dealer Online to a myVicRoads partner account and to have dealers immediately start transacting on their myVicRoads partner account.

Recently the legislated amendments to the Occupational Health & Safety Act 2004 (Victoria) (OHS Act) were introduced under the WorkSafe Legislation Amendment Act 2017. 

Do you charge customers a surcharge on transactions? From 1 September 2017, all businesses that impose payment surcharges on card transactions will need to comply with the new law that bans excessive payment surcharges.

VACC has advocated strongly for many years to have section 46 of the Competition and Consumer Act 2010 (CCA) strengthened to protect small businesses in the automotive industry. Last week, the Federal Parliament passed amendments to section 46 of the CCA, which prohibits the misuse of market power.

The Competition and Consumer Amendment (Misuse of Market Power) Bill 2017, amends the Competition and Consumer Act 2010 to strengthen the prohibition on corporations with substantial market powers from engaging in conduct that has the purpose, effect or likely effect of substantially lessening competition in markets in which they directly or indirectly participate; remove provisions in relation to telecommunications-specific anti-competitive conduct and the competition notices and exemption order regime; and make consequential amendments. The bill is currently before the House of Representatives.

In 2015 Members were advised in various VACC bulletins that the Australian Competition and Consumer Commission (ACCC) published a list of vehicles subject to a recall involving cars fitted with airbags supplied by Japanese parts supplier, Takata.

Members in Regional Victoria have reported a continuing presence of vehicles sold kerbside by private sellers or unlicensed traders. VACC understands the frustration experienced by Licensed Motor Car Traders (LMCTs) who, in some townships, see cars parked illegally or inappropriately on council or community property. We also see a trend in the instances of illegal trading of motor vehicles via on-line retailing.

Due to recent ransomware attacks, which have affected some Australian businesses, VACC are warning members to remain vigilant against scammers trying to compromise your computer security. This potentially could damage your business.

The Victorian Workplace Injury Rehabilitation and Compensation Act 2013 (WIRC) provides for the indexation of weekly payments, weekly pensions for dependants and certain other amounts stipulated under that Act on 1 July each year.

The Victorian Government today announced the Australian Supplier Payment Code, which was developed in consultation with the Business Council of Australia and is supported by the Victorian Small Business Commissioner. It will officially come into effect 1 July 2017.

Members are advised that the Final report for the Review of Australian Consumer Law (ACL), conducted by Consumer Affairs Australia and New Zealand (CAANZ), has today been welcomed by Federal Small Business Minister, Michael McCormack

An apprentice technician was conducting a service on a vehicle that was located on the ground, parked in a hoist bay. When the apprentice started the vehicle, he unknowingly bumped the gear lever into drive.  The technician then revved the vehicle and the vehicle moved forward quickly.  At the time of the vehicle moving forward unintentionally, another apprentice technician was reviewing a repair order at the workbench in front of the uncontrolled vehicle.  The apprentice was struck by the vehicle and pinned against the workbench. 

Following recent high profile cases involving franchisees breaching their obligations as employers, on 1 March 2017, the Australian Government introduced a Fair Work Act amendments bill to protect vulnerable workers in workplaces operating under franchise agreements.

VicRoads have announced as of 1 March 2017; all License Vehicle Testers will be eligible to conduct roadworthy inspections on taxi’s, provided you have the appropriate accreditation, where applicable. 

The Minister announced $2.7 million in grants will be made available under the existing Local Industry Fund for Transition (LIFT) program. It aims to assist in the creation of approximately 130 new jobs for those effected by the closure of automotive manufacturing.

Many dealer members have contacted VACC expressing frustration with the constant disruption to their dealerships when using (or attempting to use) the myVicRoads partner account. VACC understands the issue is causing inefficiencies within the dealership network and has the impact to affect customer experiences. Amongst other things, this could result in negative feedback for dealers and have financial implications on future incentive and sales targets.

Motor Vehicle repairers are being targeted by Scammers who send an email requesting work to be carried out on a car and will ask the business to pay a towing company on their behalf. VACC members have been contacted by persons involved in this scam.

The Victoria Police missing person’s squad are conducting an investigation into the disappearance of Anthony Thomas De Vito. They are seeking any information tending to identify the whereabouts of Anthony or a vehicle of particular interest.

VicRoads has advised that Licensed Vehicle Tester (LVT) applications have resumed as of 23 May 2016 after they were suspended in November 2015.

Over the past 12 months VACC has been collaborating with the Australian Financial Security Authority (AFSA) in a bid to ensure as easy, efficient and exact user experience for members of the Automotive Industry who use the Personal Property Security Register (PPSR).

Members were advised in Bulletin D01-16 of an announcement made by the Federal Minister for Major Projects, Territories and Local Government, The Hon Paul Fletcher MP, regarding reforms of the Motor Vehicle Standards Act (the ACT). The reforms will amongst other things reduce current restrictions on the parallel importation of new cars and motorcycles.
