Crackdown on Importation of Classic Vehicles

Dear Members

Recently the Department of Immigration and Border Protection issued a notice outlining requirements for importers and licensed customs brokers. This notice relates to Australia’s zero tolerance on the importation of asbestos, and goods containing asbestos. An Australia wide ban on the manufacture and use of all types of asbestos took effect in 2003 and Australia is one of the few countries in the world that currently has a “no asbestos” policy.

Any goods imported into the country including classic vehicles, motorcycles, trucks, caravans and parts are subject to extensive scrutiny by the Australian Border Force (ABF). Under the Customs Act 1901, the ABF has the power to examine goods and seek additional information from importers to determine whether products contain prohibited materials. Goods suspected of containing asbestos will be seised, and importers may be subjected to penalties or prosecution. Last year, a crackdown on vehicle imports found more than 50 cars contained the banned material.

Importers are required to have sufficient knowledge of their goods and provide specific documentation before shipment or before making any declaration on the customs form. If the information presented does not provide adequate assurance, the ABF will require importers to arrange testing and certification in Australia by a laboratory accredited by the National Association of Testing Authorities (NATA).

Unfortunately, testing can take months and can be quite costly to a business. Also, the VACC has been made aware of situations where samples taken from vehicles have caused extensive damage. Various reports  from industry indicate that the importation of classic vehicles has come to a standstill due to the crackdown.
