This week in VCAT: A weekly comparative analysis of Licensed Motor Car Traders listed in VCAT Hearings as a respondent

VACC advises Licensed Motor Car Trader (LMCT) to a new series of weekly reporting from VACC that will analyse LMCTs as respondents in a Victorian Civil and Administrative Tribunal (VCAT) Hearing.

VACC conducted the same series of weekly reports in 2023 and published the findings in the VACC paper ‘The LMCT presence in the car retailing market and VCAT.’

The reporting will take place over 17 weeks, and it is expected that a final report will be available to VACC members, government, and other stakeholders in late October 2024.

Purpose of the weekly report

The purpose of the weekly report is to inform industry and government on an approximate number of Hearings in VCAT that involve a LMCT as respondent, as well as to provide a further deep dive into comparing the LMCT sector to other sectors. In appearance at CAT as a respondent. VACC believes that too much attention is focused on LMCTs as a source of consumer detriment where other sectors transgress in greater numbers.

VACC is also concerned about the lack of resources available in VCAT to address issues related to LMCT and consumer concerns. LMCTs are greatly disadvantaged by the current 52 week wait for a full VCAT Hearing for a Goods and Services claim.

What is the research methodology?

Data is drawn from the online, publicly accessible VCAT hearing schedule on the preceding Saturday before the work week. Each VCAT Hearing listed under the Goods and Services Category is analysed to identify what type of hearing is scheduled to take place.

The data is also interrogated to review and chart the presence of other industry sectors as a comparative analysis.

How will the weekly report be distributed?

The report will be forwarded to members of VACC LMCT Divisions on the first day of each week. The weekly report will also be publicly accessible on social media platforms such as VACC LinkedIn.
