Call for industry representative appointments

VACC has received notification from the Business Licensing Authority (BLA) and Secretariat of the Motor Car Traders Claims Committee (the committee) that the Victorian Government has begun an open recruitment campaign to make industry appointments to the Motor Car Traders Claims Committee.

The BLA has asked VACC to inform its members of this recruitment campaign, as contributions by industry representatives have always enhanced the committee’s workings.

VACC encourages qualified members of the motor vehicle trading industry to nominate for a vacant position on this committee. The committee’s work is vital to the successful regulation of Victoria’s motor car trading industry, so it’s important a VACC LMCT member secures a committee position.

The committee is a statutory body established under Part 5 of the Motor Car Traders Act 1986 (Vic) (the Act). Its primary function is to determine compensation claims made against the Motor Car Traders’ Guarantee Fund (the Fund) by persons who have incurred a loss arising from a specified dealing with a LMCT as legislated under s.76 of the Act.

The Fund comprises all money received through fees or penalties under the Act (all LMCT annual licence fees paid by every Victorian LMCT make up the Fund).

Industry member expertise is essential in ensuring the committee can discharge its functions and decision-making, which includes:

  • Determining claims made by consumers against the Fund.
  • Seeking advice and information on the claim from any person or body
  • Requesting the director of CAV, police and public authorities to produce information to the committee.
     

Traditionally, there has been a small pool of industry and consumer committee representatives who sit rotationally, subject to availability. Applicants should demonstrate:

  1. Knowledge and experience in the business of motor car trading with a broad awareness and understanding of the motor vehicle industry.
  2. Knowledge of the legislative obligations of a licensed motor car trader and the ability to understand and apply legislation.
  3. Demonstrated communication and interpersonal skills.
  4. Understanding of the operations of government administration and the responsibilities of a statutory office holder.
     

Committee meetings are usually held once a month at 121 Exhibition Street, Melbourne. Previous committees have met monthly depending on caseload.
